Estate Planning: Good estate planning is the best way to maximize the chance that your wishes for the distribution of your assets will be followed after your passing. This can be accomplished with a Will, Trust or by other means. Planning also can include a Power of Attorney, Living Will, and Health Care Proxy. Properly drafted and executed documents are essential.
Probate: A Will can only become operative if admitted into probate by the appropriate court. The probate process is most often initiated by the individuals named as the executor in the Will. Once the Will is admitted into probate and the executors appointed by the court, the executors will then be able to collect the estate assets and ultimately distribute them in accordance with the terms of the Will.
Administration: If no valid Will exists and there are assets to be collected and distributed, someone must be appointed the administrator of the estate by the court. The first step in this process is petitioning the court for Letters of Administration. Once the Letters of Administration have been issued by the court, the administrators will then be able to collect the estate assets and ultimately distribute them in accordance with the laws of intestacy which govern when there is no Will.
