Estate Planning, Probate & Administration Attorney Serving New York City

Since 1992, we have guided clients through the difficult processes of estate planning and probate, and estate administration. We encourage you to seek the counsel of experienced lawyers to answer your questions and provide options to suit your needs.

We firmly believe that everyone should take the time to consider what will happen after he or she passes away. Estate planning documents such as wills and trusts exist to ensure that an individual's wishes are carried out. The more detailed these documents are, the more effective they can be in resolving or preventing disputes in the future.

Experienced Attorneys Ready to Serve You

We are experienced in representing clients with Estate Planning, Probate, and Administration.

  • Estate Planning: Good estate planning is the best way to maximize the chance that your wishes for the distribution of your assets will be followed after your passing. This can be accomplished with a Will, Trust or by other means. Planning also can include a Power of Attorney, Living Will, and Health Care Proxy. Properly drafted and executed documents are essential.

  • Probate: A Will can only become operative if admitted into probate by the appropriate court. The probate process is most often initiated by the individuals named as the executor in the Will. Once the Will is admitted into probate and the executors appointed by the court, the executors will then be able to collect the estate assets and ultimately distribute them in accordance with the terms of the Will.

  • Administration: If no valid Will exists and there are assets to be collected and distributed, someone must be appointed the administrator of the estate by the court. The first step in this process is petitioning the court for Letters of Administration. Once the Letters of Administration have been issued by the court, the administrators will then be able to collect the estate assets and ultimately distribute them in accordance with the laws of intestacy which govern when there is no Will.

Representation in Estate Matters Since 1992

If you are an Executor, Administrator of an estate, or Trustee of a testamentary trust you have fiduciary obligations to the estate, trust, and their beneficiaries. Administration of an estate or trust involves the identification and collection of estate assets, identification, and payment of estate liabilities, accounting to the beneficiaries, and distribution of the net assets to the beneficiaries. You want an experienced lawyer to assist in the administration of the estate or trust. You want an experienced attorney who understands the estate administration process and who has successfully helped others in similar situations.

At The Law Office of Krim & Krim, P.C., we assist fiduciaries with the administration process: identifying and collecting assets; valuing the assets; distributing the assets to the beneficiaries, and obtaining releases from the beneficiaries; preparing or assisting an outside accounting with the preparation of estate tax returns. In this process disputes between the fiduciaries and beneficiaries might arise. We have experience in this field as well. We have a strong commitment to personal service and attention, answering all our own phone calls and working directly with clients throughout the administration process.
